Recommendation:
3. Having carefully considered the submissions made by the
parties the Court is satisfied that serious problems face the
Company due to a downturn in business. The Court has noted that
the efforts made by the Company to find alternative jobs within
the organisation for the five clerical workers concerned in the
claim have failed.
The Union has alleged that management have increasingly been
allocating clerical work to executive staff and that the clerical
section of the workforce have suffered more staff reductions than
other categories. Management for their part have denied this.

The Company advised the Court at the hearing that the jobs of the
five workers in question have now gone because of the closure of
offices and other restructuring which has taken place and that
there is now no work for the workers concerned. The Company gave
an undertaking at the hearing, however, that any residue of the
work formerly performed by the clerical staff concerned would not
be undertaken by executive staff.
Having regard to the conflicting submissions made by the parties
regarding the allocation of clerical work within the organisation,
the Court proposes to request independent technical assessors to
examine the position concerning the trade union allegations and to
report back to the Court within a month.
In the meantime the Court recommends that the five clerical
workers in question be retained on the pay-roll and that the union
refrains from any industrial action in support of its claim.

1987, into the above dispute, the following is the recommendation
of the Court.
