EET993

FULL RECOMMENDATION

REE/98/20
DECISIONNO.EET993

SECTION 19(5), EMPLOYMENT EQUALITY ACT, 1977

PARTIES :
REVENUE COMMISSIONERS

- AND -

MS. BURKE
(REPRESENTED BY IRISH MUNICIPAL, PUBLIC AND CIVIL TRADE UNION)

DIVISION :

Chairman: Ms Jenkinson
Employer Member: Mr Keogh
Worker Member: Mr O'Neill
SUBJECT:
1. Time Limit.

BACKGROUND:

2. The Labour Court investigated the above matter on the 12th of March, 1999, in accordance with Sections 19(5) of the Employment Equality Act, 1977.

DECISION:

The Court is satisfied that the claimant did not become aware of the Revenue Commissioner's promotion review procedures until July, 1998. The Court notes that she was required to attend a review process where other males were not.

On this basis the Court is satisfied that reasonable grounds have been shown by the employee as to why a reference of this dispute was not lodged within the time limit stipulated in the Employment Equality Act, 1977.

Accordingly, the dispute will be referred to an Equality Officer for investigation.

Signed on behalf of the Labour Court

Caroline Jenkinson
19th March, 1999.______________________
LW/BCDeputy Chairman

NOTE

Enquiries concerning this Decision should be addressed to Larry Wisely, Court Secretary.
