Complaint Timetable:

Stage 1:
Within 2 months of the date of the incident - or last such date if there is more than one incident:

You should notify in writing the person/organisation (service provider) against whom you are making the complaint of discrimination, of the following:

  • The nature of the allegation
  • Your intention, if not satisfied with the response received, to seek redress by referring the case to the Director of Equality Tribunal

And you may also in that notification:

  • Ask any questions to obtain material information with a view to helping you to decide whether to refer the case to the Director

Note:
If the Director of the Tribunal is satisfied that a reasonable cause prevented you from notifying the service provider within 2 months, this period may be extended to 4 months by the Director. You need to apply for this extension.

Stage 2:
You should wait to pursue your claim further until either:
  • You have received a response to your notification

or

  • At least 1 month has elapsed since the date of notification
Stage 3:
Within 6 months of the date of the incident:

If you are not satisfied with the service provider’s response, or if they have made no response within 1 month from the date of the notification, and you wish to pursue the complaint, you should send a completed ES 3 form to the Director of the Tribunal.

Note:
If the Director of the Tribunal is satisfied that reasonable cause prevented you from sending a complaint within 6 months, He can extend this period to 12 months. You need to apply for this extension.
