Responding to a Notification
A complainant is entitled to ask for any information, other than confidential information about another person, which they feel they may need. A form is available from the Tribunal for that purpose. (ES.1)
The service provider may, if he or she wishes, provide information to the complainant by way of a reply to the complaint. A form (ES.2) is available from The Equality Tribunal for that purpose. There is no legal obligation on a service provider to reply to a notification. However it could harm a case if no reply is sent or if false or misleading information is given. This is because the Acts allow the Director to draw appropriate inferences from any such situation when dealing with a complaint.
