FULL RECOMMENDATION

REE/99/1
DECISIONNO.EET991

SECTION 19(5), EMPLOYMENT EQUALITY ACT, 1977

PARTIES :
DUBLIN CITY UNIVERSITY
(REPRESENTED BY ARTHUR COX AND CO)

- AND -

MS EILEEN COLGAN
(REPRESENTED BY W. FAWSITT, B.L.,
INSTRUCTED BY W AND E BRADSHAW, SOLICITORS)

DIVISION :

Chairman: Mr Flood
Employer Member: Mr Keogh
Worker Member: Mr O'Neill
SUBJECT:
1. Time Limit.

BACKGROUND:

2. The Court investigated the above matter on the 25th of February, 1999. The Court's decision is as follows:

DECISION:

The Court considered carefully the written and oral submissions made by the parties. The Court taking into account the background to this case and particularly the claimant's previous experience of making a complaint to the University authorities finds that reasonable cause has been shown by the claimant for not referring the case within the six months required under the provisions of Section 19(5) of the Employment Equality Act, 1977. Accordingly the Court directs that the dispute be referred to an Equality Officer for investigation and recommendation.

Signed on behalf of the Labour Court

Finbarr Flood
