This case came before the Tribunal by way of an appeal by the employer against recommendation by a Rights Commissioner references r-110700-te-11/EH and r-110706-wt-11/EH

 

The decision of the Tribunal was as follows:

 

Having heard brief evidence on this case the Tribunal upholds and affirms the recommendations of the Rights’ Commissioner under the Terms of Employment (Information) Act, 1994 and 2001, and the Organisation of Working Time Act, 1997. Accordingly, the Tribunal orders that the appellant pays the respondent €300.00 under the Terms of Employment (Information) Act, 1994 and 2001. Since the Tribunal can only deal with appeals related to leave entitlements and public holidays under the Organisation of Working Time Act, 1997, it must refuse jurisdiction to hear this appeal as it does not relate to the above.
